1. Acceptance of Terms

By creating an account, downloading the app, or otherwise accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform. If you are using the Platform on behalf of a minor, you represent that you are the parent or legal guardian and consent to these Terms on their behalf.

2. Description of Service

Xopun Xetu provides an online educational platform offering video courses, live/recorded classes, mock tests, test series, previous years' question papers (PYQs), downloadable PDFs/notes, and related study material, primarily focused on competitive examinations conducted in and for the State of Assam and allied government recruitment examinations. Some content is provided free of charge; other content is available on a paid, one-time purchase, or subscription basis.

3. Eligibility

The Platform is intended for students and aspirants preparing for competitive examinations. There is no strict minimum age to access free content; however, users under the age of 18 should use the Platform, and make any payments, under the supervision and with the consent of a parent or legal guardian. By using the Platform, you represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms (or, if a minor, that a guardian has consented on your behalf).

4. Account Registration & Security

• You must register for an account using accurate and complete information (name, email, mobile number) to access certain features and paid content.
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must notify us immediately at xopunxetu@gmail.com of any unauthorized use of your account or any other breach of security.
• One account is intended for use by a single individual only. Sharing of login credentials to allow multiple people to access paid content is prohibited and may result in suspension (see Section 9).
• We are not liable for any loss or damage arising from your failure to comply with this Section.

5. Fees, Payment & Subscriptions

• Prices for courses, test series, and subscriptions are listed on the Platform and are subject to change at our discretion. Price changes will not affect content you have already purchased.
• All payments must be made through the payment methods supported on the Platform (UPI, debit/credit card, net banking, wallets, etc.), processed via our third-party payment gateway partners.
• Access to paid courses/test series is generally granted for the validity period specified on the product page at the time of purchase (e.g., "valid until exam date" or "12 months access"). It is your responsibility to review the validity period before purchasing.
• Subscriptions, where offered, may auto-renew unless cancelled before the renewal date; renewal terms will be clearly disclosed at the time of purchase.
• All fees are inclusive/exclusive of applicable taxes (GST) as indicated at checkout.

6. Cancellation & Refund Policy

• A refund may be considered only if: (a) you were charged multiple times for the same purchase due to a technical error; (b) the purchased content was never activated/delivered to your account due to a verified technical fault on our end; or (c) as otherwise required under applicable law.
• Refund requests must be raised within [7] days of purchase by writing to xopunxetu@gmail.com with your order ID and reason for the request.
• Approved refunds will be processed to the original payment method within [7–10] business days.
• We reserve the right to accept or reject any refund request at our reasonable discretion, in accordance with this Policy.

7. Intellectual Property Rights

• All content on the Platform — including video lectures, course structure, study notes, compiled PDFs, test series, mock test questions, graphics, logos, the "Xopun Xetu" name and branding, and the app/website design — is the exclusive intellectual property of Xopun Xetu or its licensors, and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.
• Previous Years' Question Papers (PYQs): Where PYQs are sourced from official examination bodies (e.g., APSC, SSC, Assam government boards), we compile, format, and provide explanatory solutions for educational purposes. We do not claim original authorship over the underlying question papers themselves, only over our compilation, formatting, and solutions.
• Purchasing a course or test series grants you a limited, non-exclusive, non-transferable license to access the content for personal, non-commercial, educational use only, as described in Section 8. It does not transfer any ownership rights to you.

8. License to Use the Platform

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform and purchased content for your personal educational use. You may download PDFs made available for offline access solely for your personal use. This license does not permit you to:

• Reproduce, distribute, publicly display, sell, resell, rent, lease, sublicense, or otherwise commercially exploit any content;
• Upload, screen-record, download (where not expressly permitted), or share video lectures, PDFs, or test series on any third-party platform, social media, messaging app (e.g., Telegram/WhatsApp groups), or website;
• Remove, alter, or obscure any copyright, trademark, or proprietary notice;
• Use automated means (bots, scrapers) to access or extract content from the Platform;
• Reverse-engineer, decompile, or attempt to extract the source code of the app.

9. User Conduct & Prohibited Activities

You agree not to:

• Share your account credentials or purchased content access with any other person;
• Engage in cheating, impersonation, or use unfair means during mock tests or test series (e.g., using multiple accounts, sharing answer keys before test closure);
• Upload or transmit any content that is unlawful, defamatory, obscene, harassing, or infringes upon the rights of others;
• Attempt to gain unauthorized access to any part of the Platform, other users' accounts, or our servers/networks;
• Introduce viruses, malware, or engage in any activity that disrupts or interferes with the Platform's operation;
• Use the Platform for any unlawful, fraudulent, or unauthorized purpose.

10. Mock Tests, Test Series & PYQs Disclaimer

• Mock tests, test series, and practice questions are created for practice and self-assessment purposes only. While we take reasonable care to ensure accuracy, we do not guarantee that questions, answer keys, or difficulty levels will exactly match any actual examination.
• PYQs and related solutions are provided based on our research and compilation; we strive for accuracy but do not guarantee that they are free from errors or exactly represent official record.
• Rank lists, percentile scores, and performance analytics generated from mock tests are indicative and for self-evaluation purposes only, based on the pool of users who attempted the test on our Platform — they are not a prediction or guarantee of your actual result in any official examination.
• We do not guarantee selection, qualification, or any particular result in any competitive examination as a result of using our courses, test series, or study material. Exam outcomes depend on multiple factors beyond our control, including changes to exam syllabus/pattern by the conducting authority.
• If you notice any error in a question, answer key, or content, please report it to us at xopunxetu@gmail.com so we can review and correct it.

11. User-Generated Content

If the Platform allows you to post comments, doubts, reviews, or other content ("User Content"), you retain ownership of your User Content but grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute such content within the Platform for the purpose of operating and promoting our services. You agree not to post User Content that is unlawful, infringing, or objectionable. We reserve the right to remove any User Content at our discretion without prior notice.

12. Third-Party Content, Links & Services

The Platform may include links to third-party websites, official examination portals, or content (e.g., YouTube embeds, government notification links) for your convenience. We do not control and are not responsible for the content, accuracy, or practices of these third parties. Your use of any third-party service (including payment gateways) is subject to that third party's own terms and privacy policy.

13. Disclaimer of Warranties

The Platform and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure, or that any defects will be corrected. We are not affiliated with, and do not represent ourselves as being endorsed by, the Assam Public Service Commission (APSC), Staff Selection Commission (SSC), or any other government examination-conducting authority, unless expressly stated.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Xopun Xetu, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or exam outcomes, arising out of or in connection with your use of, or inability to use, the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you actually paid to us for the specific course/service giving rise to the claim in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Xopun Xetu and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your violation of these Terms; (b) your misuse of the Platform or content; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit to the Platform.

16. Suspension & Termination

• We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Platform (including unauthorized sharing of paid content).
• You may terminate your account at any time by contacting us at xopunxetu@gmail.com; however, no refund will be provided for any unused portion of a course/subscription except as described in Section 6.
• Upon termination, your right to access the Platform and any purchased content will immediately cease. Sections relating to Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law shall survive termination.

17. Modifications to the Platform & Terms

We reserve the right to modify, suspend, or discontinue any part of the Platform (including specific courses or features) at any time, with or without notice. We may also revise these Terms from time to time; the updated Terms will be posted on this page with a revised "Last Updated" date, and material changes may be notified via email or in-app notice. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 19 below, the courts at Guwahati, Assam shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or your use of the Platform.

19. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation by contacting xopunxetu@gmail.com. If the dispute is not resolved within 30 days, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Guwahati, Assam, conducted in the English language, before a sole arbitrator appointed mutually by the parties. This clause does not preclude either party from seeking urgent injunctive relief from a competent court.

20. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020 (as applicable), grievances regarding the Platform may be addressed to our Grievance Officer:

21. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Xopun Xetu regarding use of the Platform.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, internet/server outages, or government action.
